This page is provided for your use, subject to these Terms of Use. Please read these Terms of Use carefully. The Photographer reserves the right to revise these Terms of Use, so please check back periodically for changes.
Introduction
In the following terms & conditions ‘the photographer’ shall mean Kate Mannings. The client(s)’shall be those persons defined as the named persons on the booking form. These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.
Copyright
The copyright Designs and Patents Acts assign the copyright of the images to the photographer Kate Mannings.
Display
The client(s) hereby allow(s) the photographer to display any photographs covered by this contract to promote the business in advertising, brochures, magazine articles, websites, blogs, sample albums etc. This term may be waived at the discretion of the photographer for reasons of identity protection. Please submit written information to the photographer before completing the booking form.
Licenses, Coverage and Reproduction
Photographs taken during the course of the session will be at the discretion of the photographer although every effort will be made to comply with the clients requirements. The photographer shall be granted artistic license in relation to the poses photographed and the locations used.
The photographer’s judgement regarding these matters shall be deemed correct. The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving requests out.
Cameras, camera phones, camcorders or any other recording equipment is NOT permitted during any session, either in the studio or on location, without the express permission of the photographer.
Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure. Colour treatment applied to photographs can be seen on the portfolio section of this website.
The client may request one round of alterations of this colour treatment at the total discretion of the photographer.
Force Majeure
Due to any cause beyond the photographers reasonable control e.g. sudden illness, injury, victim of crime, flooding etc or in the very unlikely event of total photographic failure, shall re-arrange the photo session. Any liability shall be limited to a full refund of any fees paid.
Personal Accident
Any directions issued to clients, their guests or employees during a shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
Ownership
All digital negatives (computer files) remain the property of the photographer. The photographer will supply a copy of the edited digital negatives (JPEGS) to the client(s) for their own non-commercial use. Copies of the files may be shared with friends or family for their personal usage.
The photographer is unable to supply the client with a copy of the RAW files as these are the original, unedited files. An integral part of the photographers service is to provide professional post production services of the RAW files to generate the desired products. It is the responsibility of the client to back up the files once received. The client may contact the photographer to receive the files once more within 30 days of receiving the photos.
The photographer cannot guarantee a backup of the files after 1 month of the session date.
Files may not be given or shared with third parties for commercial usage (e.g. clothing companies, blogs ) without the written consent of the photographer. For all inquires regarding commercial usage, please direct the supplier to the photographer via hello@katemannings.co.uk
Cancellation Fees
There is a 14 day cooling off period when the session is booked. The client many cancel any booking from the date the photographer acknowledges receipt of the booking form. The client will receive a refund of any fees/deposits paid within the 14 days cooling off period. The client may cancel the booking prior to the agreed session date in the booking form after the 14 days cooling off period, thereby forfeiting all deposits paid, by written notice to Photographer via hello@katemannings.co.uk
Re-arranging sessions + Fees
Due to the nature of children becoming unwell the photographer endeavours to be reasonable and flexible. Please contact the photographer in writing and by phone in advance of the session (at least 2 hours before the start of the booking time) to re-arrange the session.
The photographer will allow one session to be re-arranged without incurring a fee.
Upon informing the photographer, the client will have the option of rearranging the session to an alternative date within 1 month of the original booking date, where there is availability. Upon booking, the photographer will ask you to keep an alternative date available for this purpose.
Should the client cancel the second session, the photographer will retain 50% of the session fee. In order to book another date with the photographer the balance will need to be paid in advance before scheduling an alternative date.
Should the client cancel the third session, the photographer will retain 100% of the session fee.
Session timings + fees
It’s very important clients are punctual for their session. Should the client be late for the scheduled session, this time will be deducted from the agreed timings of the booking. E.g If the session is for 1 hour, but the client is late by 15 minutes, the session will be 45 minutes in total. Should the photographer be late, this time will be added to the session. Reducing the session time may have an impact on the amount of photos you will receive as a consequence.
Should the client be late by at least 30 minutes, the client must inform the photographer by phone. Upon informing the photographer, the client will have the option of rearranging the session to an alternative date within 1 month of the original booking date, where there is availability. 50% of the session fee will be retained to cover the photographers loss of time. If the client is not contactable by phone or does not contact the photographer by phone this will be classed as a no show and the full session fee will be charged.
Mini Sessions
It’s very important clients are punctual for their session. Should the client be late for the scheduled session, this time will be deducted from the agreed timings of the booking. E.g The session is 20 minutes, but the client is late by 5 minutes, the session will be 15 minutes in total.
Reducing the session time may have an impact on the amount of photos you will receive as a consequence.
The date and time agreed upon booking are non transferable and the session fee is non-refundable.
Deliverables
The deliverables for your session will be stipulated on the website and in the booking form or via email. You will receive the specified number of digital files in Jpeg format. The photos will be delivered and displayed using a private online gallery which shall remain online for 30 days. The Jpegs files provided will be sized to the standard photo size of at A4 at 300dpi for print. The photos will be edited, colour treated and key portrait photos retouched (*basic retouching)
* Basic retouching means to remove or make corrections the photographer deems necessary, such as the removal of blemishes, dust marks.
Payments & Deposit
A non-refundable booking fee of £100 will confirm your booking, as well as full acceptance of the terms and conditions. The booking fee will be deducted from the cost of the client’s chosen session when calculating the final balance due.
Payment in full of the remaining balance will be due one week before the session. Titles to all goods remains with the photographer until paid for in full by the client(s)
Please pay via internet banking or bank transfer payable to Kate Mannings. Deposit details will be included on the invoice once the photographer receives your completed booking form.
Booking Summary
By completing the booking form and submitting it to Kate Mannings Photography or making the deposit payment described above, you confirm you have read, understand and agree to all the terms and conditions on this page of the website to use our photographic services on your wedding day.
